Heard learned counsel for the applicant, learned AGA for the State and perused the record. The instant application under section 483 Cr.P.C. has been filed with the prayer to direct the learned Judicial Magistrate/ATS, Court, Lucknow to get the prosecutrix/applicant examined in case, summon the accused the under Sections 376/392 IPC and commit the case for trial to Sessions Court, for expeditious framing of charges and concluding of trial in case No. 26956 of 2023; State Vs. Syed Waseem Riazvi, as per procedure and law, especially Section 309 of Cr.P.C./346 BNSS, 2023, expeditiously. Learned counsel appearing for the applicant submits that the matter pertains to the year 2023, but even after passing of two years, the proceeding of the case has not been concluded as yet. After arguing at length, learned counsel appearing for the applicant submits that interest of justice would be sub-surved if this Hon'ble Court may be pleased to direct the trial court to decide the matter within the stipulated period of time as may be fixed by this court. Considering aforesaid innocuous prayer, the learned Judicial Magistrate/ATS, Court, Lucknow is directed to decide the case No. 26956 of 2023; State Vs. Syed Waseem Riazvi, arising out of Case Crime No. 130 of 2021, under Section 323/504/506 IPC, Police Versus Counsel for Applicant(s) : Syed Azizul Hasan Rizvi Counsel for Opposite Party(s) : G.A. Smt. Rooma .....Applicant(s) State Of U.P. Thru. Its Prin. Secy. Deptt. Of Home Lok Bhawn Lko. And 2 Others .....Opposite Party(s) Station Sadatganj, District Lucknow, with expedition, in accordance with law considering the instructions and guidelines issued by this court; time to time.
