Applicant-accused was convicted for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881. In Criminal Appeal (Criminal Appeal No.103 of 2024), filed by the applicant, the learned Vth Additional Sessions Judge, Dehradun directed the applicant to deposit twenty percent of the fine amount. The appellant had not deposited the amount, hence, a warrant has been issued against him. Hence, the present Application, under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023. 2. Heard Mr. Neeraj Parihar, learned counsel for the applicant and Mr. Akshay Latwal, learned Assistant Government Advocate for the respondent no.1. 3. Mr. Neeraj Parihar, Advocate, has submitted that negotiations regarding a settlement are underway 1 2025:UHC:11609 with the complainant. Applicant undertakes that he shall deposit the said amount, as directed by the Appellate Court, within ten days’ from today. 4. In the interest of justice, time, as prayed by the applicant, is granted. The effect and operation of the warrant, issued against the applicant, are kept in abeyance until 08.01.2026, unless it is cancelled earlier by the appellate court. 5.
