p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.1686 of 2025 Bipin Raula @ Bipin Kumar Raula …. Petitioner Mr. J. Sahoo, Advocate -Versus- State of Odisha …. Opposite Party Mr. P. Satapathy, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 10.03.2025 01. 1. Heard Mr. Sahoo, learned counsel for the petitioners and Mr. Satapathy, learned ASC for the State. 2. Instant petition under Section 483 BNSS is filed for release of the petitioner on bail in connection with Rambha P.S. Case No.72 of 2025 corresponding to G.R. Case No.206 of 2025 pending in the file of learned J.M.F.C., Khallikote on the grounds stated therein. 3. On a reading of the rejection order i.e. Annexure-2, this Court finds that there has been no visible injury noticed, whereas, another injured was not even medically examined. As it appears, there was a village dispute, for which, the alleged incident took place. One of the accused persons has been released on bail and it was denied in the case of the petitioner because of his antecedents. According to learned ASC for the State, the petitioner is having six other cases but replied by claiming that the same are due to political rivalry. For the fact that none received any external injury as made to appear from Annexure-2 and the fact that the co-accused is on p. 2 bail and the petitioner is in custody from 27th January, 2025, this Court is inclined to release him on bail with similar conditions. 4. Hence, it is ordered. 5. In the result, petition under Section 483 BNSS stands allowed. Consequently, the petitioner is directed to be released on bail in connection with Rambha P.S. Case No.72 of 2025 corresponding to G.R. Case No.206 of 2025 subject to him furnishing a bail bond of Rs30,000/-(Rupees thirty thousand) with one solvent surety for the like amount to the satisfaction of learned J.M.F.C., Khallikote, who shall impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, he shall not be involved in similar criminal offences, while on bail; and shall not create any sort of disturbance in the village; shall not tamper with evidence and terrorize or influence the witnesses connected to the case in any manner and shall co-operate with police during investigation till the same is over. 6. The BLAPL is disposed of. 7. Urgent certified copy of this order be granted as per rules. Alok (R.K. Pattanaik) Judge
