This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No. 74/2024 registered at Police Station Kelhari, District Manendragarh- Chirmiri-Bharatpur (C.G.) for the offence punishable under Section 20-B of NDPS Act. Manendragarh- Chirmiri Baikunthpur (C.G.) have received the secret information regarding transport of the contraband articles through vehicle No. MP-04-CL-1030 so the information is recorded in the Rojnamcha search team was constituted and the witnesses were called and the search was made near Manchhidand bridge and alleged to have seized 56 kg contraband article Ganja from the dickey of the vehicle from the possession of co-accused Raju Kori and Sandeep Sharma and they were arrested for the alleged commission of offence. The memorandum statement of said Raju Kori is recorded in which he stated that the vehicle is hired by the present applicant in rate of Rs. 15 per Km to attend the marriage function and he has given a sum of Rs. 5,000/- to the accused Raju for travel the vehicle from Panna M.P. so on the basis of memorandum of co- accused applicant was arrested on 08.01.2025 and after completing the investigation charge sheet is filed on 24.02.2025. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. He further submits that no contraband article i.e. 56 Kg Ganja has been recovered from the physical possession of the applicant as the same was recovered from the co-accused and in the memorandum statement of said co- accused it has been stated by him that the applicant had got the contraband article loaded on the vehicle in question which was driven by the co-accused and applicant travelled by train. He would submit that charge sheet has been filed, applicant is in jail since 8/01/2025 and conclusion of trial is likely to take some time, therefore, he prays 3 for grant of bail to the applicant. 4. On the other hand, learned counsel for the State opposes the bail application and he would submit that the charge sheet has been filed in this case. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, nature & gravity of the offence and also considering the fact that the applicant had got the contraband article i.e. 56 Kg Ganja loaded on the vehicle in question which was driven by the co-accused which is much above the commercial quantity and the applicant travelled by train, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant-Dannu @ Dinesh Sonkar involved in Crime No. 74/2024 registered at Police Station Kelhari, District Manendragarh-Chirmiri-Bharatpur (C.G.) for the offence punishable under Section 20-B of NDPS Act, is rejected. 7.
