O R D E R This petition has been filed seeking to strike off the proceedings in D.V.C.No. 34 of 2024, on the file of the learned Judicial Magistrate No. I, Thoothukudi 2.Learned Senior Counsel for the petitioners would submit that the first petitioner is the husband of the respondent and other petitioners are the in-laws of the respondent. The respondent wife filed domestic violence case on the file of the learned Judicial Magistrat No.I, Thoothukudi. Challenging the same, the present Civil Revision Petition. 3.Learned Counsel for the petitioner would submit that the present Civil Revision Petition has been filed solely on the ground of jurisdiction and the same is hit by Section 27 of the Protection of Women from Domestic Violence Act, 2005. The occurrence took place at Sivagangai, Ramanathapuram and Coimbatore and not within the jurisdiction of Thoothukudi. However, the respondent has vexatiously filed Domestic Violence Case at Thoothukudi, just the put the petitioners in hardship. However, learned Senior Court would submit that this Court may issue a direction to the trial Court to dispose of D.V.C. 2/5 https://www.mhc.tn.gov.in/judis
C.R.P.(MD)No. 2781 of 2024 No. 34 of 2024, within a reasonable time frame and also permit the petitioner to canvas all those issues including the jurisdiction issue. 4.Learned Counsel for the respondent has no serious objection for the same. 5.Accordingly, this Court without going into the merits of the matter, directs the learned Judicial Magistrate No.1, Thoothukudi, to dispose of D.V.C.No. 34 of 2024, within a period of three [3] months from the date of receipt of a copy of this order. The petitioner is also at liberty to canvass all the points raised herein including the jurisdiction issue before the trial Court. 6.Accordingly, this Civil Revision Petition stands disposed of.
