HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 8174 of 2025 Court No. - 1 HON'BLE RAJAN ROY, J.
HON'BLE MANISH KUMAR, J.
1. Heard Shri Jalaj Kumar Gupta, learned counsel for petitioner, Shri Chandra Shekhar Pandey, learned counsel for the opposite party as well as learned Standing Counsel.
2. By means of this petition, the petitioner has challenged an order dated 13.12.2023, passed under Section 33 A of the Water Act, 1974.
3. The petition is highly belated apart from the fact that the statutory remedy of appeal has not been availed and there is hardly any explanation offered in the writ petition for the delay.
4. We see no reason to interfere in the matter.
5. At this stage, learned counsel for petitioner says that the petition may be allowed to be withdrawn with liberty to the petitioner to pursue other remedies, if any.
6. Accordingly, the present writ petition is dismissed as withdrawn with liberty aforesaid, if otherwise, permissible in law.
