Cooperative Societies Act, 1960. 2) Evidently, the order passed by the Deputy Registrar, Cooperative Societies U/s 64 of the Act, 1960 whereby civil rights of petitioner has been decided is appealable according to the provisions of Section 78 of the Act, 1960, therefore, instant petition is not maintainable. 3) Consequently, this petition being not maintainable stands dismissed. However, petitioner will be at liberty to take recourse to law. Certified copy be returned after retaining its xerox copy. 4) It is expected that the appellate authority would consider the application for condonation of delay, if so moved by the petitioner taking lenient view as the matter remained pending for considerable period. 5) It is made clear that this Court has not expressed anything on the merits of the case.
