Heard learned counsel for the petitioner and Shri Vinay Shankar, learned counsel for the respondent. 2. The present petition has been filed by the petitioner aggrieved against the action of the respondent-Bank in issuing notices under Section 13(4) of the SARFAESI Act. 3. The contention of learned counsel for the petitioner is that the petitioner had approached respondent-Bank for One Time Settlement and had also paid a part of the said outstanding amount, however, no decision has been taken on the O.T.S. application. 4. Learned counsel for the respondent-Bank states that the said O.T.S. application was moved in December, 2023 and the same is not pending with the respondent-Bank. 5. Without going into the merits of the case, the present petition is disposed of directing that the O.T.S. application filed on 21.12.2023 is pending with respondent No.3, the same will be considered and decided within a period of two weeks from today. In case, the said application is already disposed of, the petitioner would be entitled to move a fresh application for O.T.S., which shall also be considered by the respondent- Bank within a period of two weeks from the same being filed.
