JUSTICE MITALI THAKURIA ORDER 30.07.2025 Heard Mr. D. Ullah, learned counsel for the petitioner. Also heard Ms. S. H. Bora, learned Additional Public Prosecutor for the State respondent. It is submitted by the learned Additional Public Prosecutor, Ms. Bora, that a report has already been received from Garchuk Police Station, from which it appears that, on the basis of GD Entry No. 28 dated 10.07.2025, an initial enquiry has been conducted by the police of Garchuk Police Station. However, till date, no case has been registered against the present petitioner. In that context, Mr. Ullah, learned counsel for the petitioner, has submitted that there is an apprehension of a case being registered against the petitioner due to a land dispute. However, as of now, the petitioner has not received any communication from the police, nor has he received any notice under Section 35(3) of the BNSS requiring his cooperation in the enquiry being conducted by Garchuk Police Station. Nonetheless, the petitioner is ready and willing to extend full cooperation if he receives any such notice from the said police station. In view of the above, the present anticipatory bail application stands closed and disposed of. However, Garchuk Police may take appropriate steps to issue notice to the petitioner, if his presence is required for the purpose of enquiry in connection with Garchuk P.S.
