Neutral Citation No. - 2025:AHC-LKO:41627-DB Court No. - 2 Case :- WRIT - C No. - 7848 of 2022 Petitioner :- Shivam Pandey And Others Respondent :- State Of U.P. Thru. Addl. Chief Secy. Public Work Deptt. Civil Sectt. U.P. Lko. And Others Counsel for Petitioner :- Surya Kant Singh,Shubham Singh Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Manish Kumar,J. The Standing Counsel makes a statement that the petitioners are not being compelled to execute a sale deed in favour of the official opposite parties. The counsel for the petitioners says that the offer to purchase the land does not provide adequate
consideration in keeping with the relevant Government Order. Unless such consideration is provided, the petitioners are not willing to sell the land to the official opposite parties. We are not aware of any law under which the petitioners can be compelled to sell their land. Of course, if the official opposite parties so desire, the land can be compulsorily acquired, but only as per law. The Standing Counsel has also made a statement that the opposite parties are not compelling the petitioners to sell their land. In view of the above, nothing survives for adjudication in this writ petition. The same is
disposed of accordingly. The opposite parties shall be bound by what has been observed hereinabove. (Manish Kumar, J) (Rajan Roy, J)
