Borpatra Gohain, learned counsel for the respondent No.1; and Ms. L. Sarma, learned counsel for the respondent No.4. This application has been preferred by the applicant praying for condonation of delay of 1024 days in filing the connected interlocutory application for substitution of the legal heirs of the deceased/claimant namely Smti. Joonaki Bora. It is submitted by Mr. Sarma, learned counsel for the applicant, that during the pendency of MAC Appeal No. 280/2019, the claimant, Smti. Joonaki Bora, passed away on 21.05.2019. The learned counsel further submits that there was no willful negligence on the part of the applicant in filing the substitution petition. The grounds for the delay have been duly explained in paragraph Nos. 3 and 4 of the instant application. Furthermore, the learned counsels appearing on behalf of respondent Nos. 1 and 4 have raised no objection to the condonation of the delay of 1024 days in preferring the connected I.A.(C) No. 2495/2024. In view of the above, and in the interest of justice, the interlocutory Page No.# 3/3 application for condonation of delay is hereby allowed. The delay of 1024 days in filing the connected interlocutory application, i.e., I.A.(C) No. 2495/2024, stands condoned The Interlocutory Application stands disposed of in terms above.
