We have heard learned counsel for the review applicants and also counsel appearing on behalf of the writ-petitioners- Shripal and Sahaj Ram as well as counsel appearing on behalf of respondent nos. 6, 7 and 8. 2. This review application has been filed with a delay of 79 days. We have gone through the application for condonation of delay along with affidavit and we find that the reasons given therein are sufficient. The delay in filing the review application is condoned. The review application shall be treated to have been filed in time. 3. We have gone through the order dated 2.5.2024 passed by us in Writ -C No. 3988 of 2024 and also copy of the writ petition, which was disposed of by this Court. It is evident from the same that review applicants-Ram Singh, Balvan and Smt. Shyam Kali, heirs of Hari Lal, were not impleaded as respondents in the writ petition, although they were necessary and proper parties, as the order sought by the writ petitioners was likely to prejudice the rights of the review applicants. 4. Without entering into the merits of the case as set by the review applicants, we recall our order 2.5.2024 only on the ground that review applicants were not impleaded as parties and their rights were likely to be affected by any order passed in the writ petition. Writ -C No. 3988 of 2024 is accordingly restored to its original number. 5. List the writ petition before the appropriate Bench. 6. The review application is disposed of.
