HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 8098 of 2025 Court No. - 12 HON'BLE KARUNESH SINGH PAWAR, J.
1. Heard learned counsel for the applicants, learned AGA for the State and perused the record. 2. In the prosecution case, it is alleged that the complainant's daughter was married to the co-accused about ten months ago. At the time of marriage, the complainant gave a Platina motorcycle, articles worth Rs. 20,000/-, and Rs. 90,000/- in cash as dowry. However, the in-laws were dissatisfied with the dowry provided and allegedly demanded an additional Rs. 1,00,000/-. Due to this demand, the deceased was subjected to cruelty and was ultimately murdered by hanging on 29.03.2025. 3. Learned counsel for the applicant submits that the applicant is the brother-in-law (dewar) of the deceased. It is pointed out that the co- accused, Savitri Devi (mother-in-law of the deceased), has already been granted bail by a coordinate Bench of this Court vide order dated 24.06.2025 in Criminal Misc. Bail Application No. 5463 of 2025. It is further submitted that there were no antemortem injuries on the body of the deceased except a ligature mark, and the cause of death was asphyxia due to antemortem hanging. The applicant is in custody since 19.07.2025 and has no criminal antecedents. The complainant’s statement contains only general allegations against all accused persons. 4. It is further submitted that there is no possibility of the applicant fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of Versus Counsel for Applicant(s) : Dheeraj Srivastava Counsel for Opposite Party(s) : G.A. bail. 5. Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for the applicant. 6. On due consideration of the bail order of co-accused Savitri Devi; the general nature of the allegations; the absence of any prima facie indication that the deceased was subjected to cruelty in connection with dowry demand soon before her death; and the fact that the applicant is in custody since 19.07.2025 and has no criminal antecedents, I find it to be a fit case for enlarging the applicant on bail. 7. Accordingly, the bail application is allowed. 8.
