Petitioner is a civil contractor, who was awarded a contract for construction of a building at Shitlakhet, Almora by Bharat Scout and Guide, U.P.
5. The grievance raised by the petitioner is that despite completing the construction work to the satisfaction of concerned authorities, the payment due to him, is not being released. 6. By means of this writ petition, petitioner has sought the following reliefs: -
“(i) a suitable writ order or direction in the nature of mandamus commanding the respondents to m ake paym ent of Rs. 11,13,217/ -as arrears of the am ount of contract work executed by the petitioner pursuant to the Contract Agreement dated 13.11.2019 entered between the petitioner and respondent no. 2 and 3 in respect of the construction of State Training Centre Scout Guide Sheetlakhet District Almora and Rs. 34,28,927/ - including GST the amount of additional changed work conducted by the petitioner on the instruction of the respondent no. 2 and 3), and Rs. 10,00,000/ - which was deposited by the petitioner as security amount vide Bank Drafts dated 24.9.2019 and 2.11.2020 (Total Rs. 55,42,144/ -) with interest payable thereon. (Contained as Annexure No.1, 2 & 3 to this writ petition).”

Since petitioner has sought a writ of mandamus and he has also made a representation, we think that ends of justice would be met, if petitioner is permitted to make fresh representation, as prayed by learned counsel. 8. The writ petition is, accordingly, disposed of with liberty to petitioner to make fresh representation, highlighting his grievances. The break-up of the amount, which remains unpaid according to him, shall also be disclosed in the representation. If petitioner makes such representation within two weeks from today, the Secretary, Bharat Scout and Guide, U.P./ respondent no.
3, shall take decision thereupon, as per law, within four weeks from the date of presentation of such representation. If the amount claimed by the petitioner is found to be payable, necessary orders for release of such amount shall be passed within four weeks of taking such decision. ( Subhash Upadh yay,.J.)
