Today when the petition is taken up for hearing, learned Assistant Public Prosecutor has produced a copy of instructions of the Inspector of Police, Kavali I Town Police Station, SPSR Nellore District wherein it is stated that after due investigation, the Police have filed a charge sheet on 10.10.2020 vide C.C.No.234 of 2022 on the file of Additional Judicial Magistrate of First Class, Kavali. 3. In view of the fact that a charge sheet vide C.C.No.234 of 2022 has already been filed on the file of Additional Judicial Magistrate of First Class, Kavali, pending the present petition, learned counsel for the petitioner sought permission of this Court to withdraw the present petition. 4. Permission as sought for is accorded. Accordingly, this criminal petition is dismissed as withdrawn, with a liberty to challenge the aforesaid charge sheet, if at all aggrieved by the same.
