Non-applicant For Applicants : None For Non-applicant : Mr. Amit Verma, Panel Lawyer. Hon'ble Shri Ramesh Sinha , Chief Justice Order on Board 07.04. 2025 1. Proceedings of this matter have been taken through video conferencing. 2. This is an ofÏce reference. 3. This Court, vide order dated 07.11.2023, passed in MCRC No. 7049 of 2023, while allowing the bail to the applicant, namely, Harish Sharma, had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a certified copy of the order, if there was no legal impediment. KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN 2 4. Earlier on two occasions also this Court had granted extension of time for compliance of the order dated 07.11.2023. 5. The learned Special Judge (Protection of Depositors Interest Act), Surajpur, District-Surajpur, (C.G.) vide his request letter dated 22.03.2025 has requested for grant of six months time for concluding the trial. 6. It transpires from perusal of the PUD that in this case, the crime was registered in different districts of Chhattisgarh State and the accused of the said case was lodged in jail of other State, due to which it is taking time to resolve the case and in this case, charge-sheet has been prepared against accused Abhishek Chauhan, Harish Sharma, Ashish Chauhan, Niranjan Saxena, Prabhal Pratap Singh, Lakhan Soni and Vikas Vijayvargiya and another accused of this case, Ashish Nayak, was continuously absent at the stage of charge after bail and arrest warrant was repeatedly issued against him. Due to the absence of the said accused, there was delay in the trial of the case, due to which the case of the said accused was separated and he was declared absconder and the case has been fixed for prosecution evidence by passing an order of permanent arrest warrant against him. The case is being continuously fixed and tried, in which the statement of a total of 07 prosecution witnesses have been recorded and it is likely that it will take time to register the crime in various districts of Chhattisgarh State and summon prosecution witnesses from remote districts for evidence. Hence, the conclusion of the trial is likely to take some time, therefore he prays for grant of further six months time for concluding the same. 7. The request appears to be reasonable. The concerned trial Court is 3 directed to conclude the trial as early as possible, preferably within a further period of six months from today. 8. Accordingly, this CRMP stands disposed off with the aforesaid direction. 9. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/- (Ramesh Sinha) Chief Justice Kunal
