Dubey, Advocate ------ Order No. 02 / Dated : 05.06.2025. Heard learned counsel for the parties. 2. The petitioners are apprehending their arrest in connection with Domchanch P.S. Case No. 32/2025 for the offences registered under Sections 191(1), 190, 127(1), 115(2), 132, 303(2), 317(5), 352, 351(2), 3(5) of Bharatiya Nyaya Sanhita, 2023 and 54 of JMMC Rule. 3. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. He further submits that the petitioners have no concern with the mining of mica scrap and the petitioners were also not present at the place of occurrence. He lastly submits that the petitioners are daily wages laborer and have been made victim of circumstances. 4. Learned A.P.P. opposed the prayer for anticipatory bail. 5. Having regard to the facts of the case and looking to the allegation made against these petitioners, I am inclined to enlarge the petitioners on anticipatory bail. Accordingly, the petitioners are directed to surrender before the court below within a period of four weeks from today and the learned court below on their surrender shall release him on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Koderma in connection with Domchanch P.S. Case No. 32/2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. 6. It is made clear that the petitioners shall cooperate in the investigation/trial and if the petitioners will not cooperate in the investigation/trial, the State would be at liberty to take appropriate action.
