By means of the instant application, the applicant seeks expeditious disposal of his application under Order 39 Rule 1 of C.P.C. filed in Suit No. 366 of 2025. 3. Having considered the aforesaid submissions as well as from perusal of the material on record, it appears that the suit was filed only in the month of July, 2025. The matter was listed on 1st August, 2025 and it has not been disclosed as to what transpired on the said date. 4. Be that as it may, since the suit is of year 2025 and there is no material on record to indicate as to why the application under Order 39 Rule 1 could not be heard as there is insufficient material on record regarding the service on pendency. 5.
