Heard learned counsel for the applicant, learned AGA for the State and perused the record. The instant application under section 483 Cr.P.C. has been filed with the prayer to direct the trial court to conclude the trial in Gangster No. 228 of 2008, State Vs. Durgesh Singh, in Case Crime No. 1943 of 2008, under Sections 384, 420, 395, 412 IPC and Section 2/3 of U.P. Gangster Act, Police Station Kotwali Nagar, District Sultanpur, expeditiously. Learned counsel appearing for the applicant submits that the matter pertains to the year 2008, but even after passing of seventeen years, the proceeding of the case has not been concluded as yet. After arguing at length, learned counsel appearing for the applicant submits that interest of justice would be sub-surved if this Hon'ble Court may be pleased to direct the trial court to decide the matter within the stipulated period of time as may be fixed by this court. Considering aforesaid innocuous prayer, the trial court concerned is directed to conclude the trial in Gangster No. 228 of 2008, State Vs. Durgesh Singh, in Case Crime No. 1943 of 2008, under Sections 384, 420, 395, 412 IPC and Section 2/3 of U.P. Gangster Act, Police Station Kotwali Nagar, District Sultanpur, with expedition, in Versus Counsel for Applicant(s) : Supriya Tiwari, Dhananjay Yadav Counsel for Opposite Party(s) : G.A.
