This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No. 607/2024 registered at Police Station Kasdol Distt- Balodabazar- Bhatapara (C.G.) for the offence punishable under Sections 296, 109, 3(5), 191(2) of B.N.S.S. 2023. As per the case of the prosecution, on 30.12.2024 at around 08:00 P.M. the complainant Himanshu Sahu was standing near Durga Chowk with his friend when Kisan Sahu called Raunak Sahu near the stadium Garden. When Raunak Sahu reached the stadium Garden along with his friends namely Amar Sahish, Nikhil, Rounak Om, Som, Bhavesh and Golu, Kisan Sahu was standing there with Gulshan Sahu, Himanchal Sahu, Praveen Kosale Rupesh Kewat. When Raunak Sahu asked applicant why he has called him, then Gulshan Sahu, Himanchal Sahu, Rupesh Kewat, Praveen, Kisan all five got angry and with common intention started abusing the complainant and threatened them for life and assaulted them with knife.

Learned counsel for the applicant submitted that there are three accused persons including the present applicant and it is stated that the co-accused had assaulted the injured with hands and fist whereas the applicant is said to have caused injuries by knife. It is stated that the co-accused have been granted bail by the court below, charge sheet has been filed and the applicant is in jail since 31/12/2024 and conclusion of trial is likely to take some time, therefore, he prays for grant of bail to the applicant.

On the other hand, learned counsel for the State opposes the bail application and he would submit that the applicant had caused injuries to the injured by knife who received multiple incised wound on his person and the injuries were found to be grievous and dangerous to life, therefore the applicant is not entitled for grant of bail.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the facts & circumstances of the case, nature & gravity of the offence and also considering the fact that the applicant caused injuries to the injured by knife who received multiple incised wound on his person and the injuries were found to be grievous and dangerous to life, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant- Kisan Sahu involved in Crime No. 607/2024 registered at Police Station Kasdol Distt- Balodabazar-Bhatapara (C.G.) for the offence punishable under Sections 296, 109, 3(5), 191(2) of B.N.S.S. 2023 is rejected.
