Heard learned counsel for the applicants, learned AGA for the State and perused the record. The instant application under Section 482 Cr.P.C. has been filed with the prayer to quash the impugned order dated 22.01.2025 passed by learned Additional District & Sessions Judge/Special Judge (EC Act), court no. 4, Sultanpur in Sessions Trial No. 632 of 2024; State Vs. Ramesh Sonkar and others, arising out of Case Crime No. 204 of 2020, under Sections 323, 308, 427, 452, 504, 506 IPC, Police Station Dostpur, District Sultanpur. Learned counsel for the applicants, while pressing the application, submits that the charges have been framed in contravention of the provisions prescribed under the Code of Criminal Procedure. He submits that the nature of injuries have not been considered in its right perspective, thus, submission is that the order framing charges dated 22.01.2025 may be set aside. Learned Counsel for the State has opposed the contentions aforesaid and has submitted that there is no ambiguity in the order dated 22.01.2025. Considering the submissions of learned counsel for the parties, it transpires that the learned trial court has passed the order, while very well considered the mandate of provisions of Code of Criminal Procedure and Versus Counsel for Applicant(s) : Ramakar Shukla Counsel for Opposite Party(s) : G.A. Ravindra Pratap Sonkar @ Virendra And 14 Others .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Lko. And Another .....Opposite Party(s) thus, no interference is warranted.
