OMP (M) No.417 of 2025 The present application has been filed by the appellant/ applicant for condonation of delay in filing the present appeal. It has been averred in the application that copy of judgment dated 03.07.2024 passed by the learned District Judge, Mandi, Division Mandi, H.P was applied by the counsel of the appellant/applicant on 12.12.2024 and the same was delivered on 08.01.2025. After getting the copy of the judgment, steps were taken for engaging counsel for filing the present appeal before this Court. It is averred that the delay in filing the present appeal is neither intentional nor willful but the same has occurred due to unavoidable circumstances, which were beyond the control of the appellant/applicant. In view of the averments made in the application, which is duly supported by an affidavit and taking into consideration the submission as made by the learned counsel for the appellant/applicant and in view of the no objection by the non- applicants, the present application is allowed and the delay in filing the present appeal is condoned.
