By means of the instant petition, the petitioner seeks expeditious disposal of a suit for declaration and injunction filed by the plaintiff relating to the year 2016. 3. It is urged that several dates have been fixed, but till the date, the suit has not been considered. Consequently, an expedite order be passed. 4. The Court has considered the aforesaid and also perused the material on record. 5. This Court finds that the entire order-sheet has not been brought on record. Even though the issues were framed in the year 2017 which also, inter alia, included the determination as to whether the plaint is liable to be rejected under Order VII Rule 11 CPC had also been framed. However, the entire order-sheets has not been brought on record and there are large gaps and in view thereof, it is not feasible for this Court to ascertain as to the cause of delay. 6. In view of the aforesaid, this Court is not inclined to entertain the petition, which is dismissed leaving it open for the petitioner to move an appropriate application before the Court concerned. In case, such an application is moved needless to say the same shall be considered and pass appropriate order in accordance with law.
