HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW PUBLIC INTEREST LITIGATION (PIL) No. - 892 of 2025 Court No. - 1 HON'BLE RAJAN ROY, J.
HON'BLE MANJIVE SHUKLA, J.
1. Heard Shri Vinay Kumar, learned counsel for the petitioners, learned Standing Counsel for the respondent nos.1 to 7 and Shri Pankaj Gupta, learned counsel for the respondent no.8. 2. The instant writ petition, in the form of a public interest litigation, has been filed seeking therein, the following reliefs:
"1. To issue a writ, order or direction in the nature of Mandamus commanding and directing the opp. party no.1 to 8 to restrain the illegal construction of Shankar ji's Ardha platform made by the private opp. parties, over the land in question, with immediate effect to maintain the law and order of the area, in the interest of justice. 2. To issue a writ, order or direction in the nature of Mandamus commanding and directing the opp. party no.1 to 8 to take a legal action against the private opp. parties (opp. party no.9 to 21) and other involved persons, being disturbing the law and order as well as peace of the area, in the interest of justice." Versus Counsel for Petitioner(s) : Vinay Kumar, Farhan Ahmad Khan, Narendra Pratap Singh, Sandeep Kumar Ojha, Satvinder Singh, Shahid Salam, Touqeer Ahmad Counsel for Respondent(s) : C.S.C., Pankaj Gupta Mustakim And 6 Others .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Home Deptt. Govt. Of U.P. Lko. And 20 Others .....Respondent(s)
3. Learned counsel appearing for the petitioners has contended that at earlier point of time a compromise had been entered into in between the residents of the village belonging to the two communities and under that agreement it was decided that no construction would be raised over the land in dispute. He further contends that now the residents belonging to one community are not obeying the earlier mutual agreement and therefore it is necessary that this Court should interfere in the matter and restrain the respondents from raising any construction over the land in question. 4. We have considered the submissions made by the learned counsel appearing for the petitioners and we find that it is a purely civil dispute in between the parties and writ petition is not a remedy for implementation of any compromise entered into in between the parties. 5.
In view of the aforesaid reasons, we do not see any ground to entertain this writ petition. 6. Accordingly, the writ petition is dismissed with liberty to the petitioners to avail other remedies available to them under law. August 29, 2025 akhilesh/- WPIL No. 892 of 2025 2 (Manjive Shukla,J.)
