Prayer in this petition, filed under Section 482 of the BNSS, 2023, is for grant of anticipatory bail to the petitioner, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:- Name of Petitioner (s) FIR No. Date Section(s) Police Station District Charanjeet Singh @ Channi 01 01.01.2025 21(b) of NDPS Act, 1985 Rori Sirsa 2. On 24.01.2025, following order was passed:- “1. Present petition has been filed by the petitioner namely Charanjeet Singh @ Channi, aged about 32 years, for grant of anticipatory bail, in case bearing FIR No.1, dated 01.01.2025, under Sections 21(b) of the NDPS Act, registered at Police Station Rori, District Sirsa. 2. Counsel for the petitioner submits that the petitioner is a young person, and except of his involvement as shown in the present case, no other similar activity is recorded against his credit. 3. Further submits that in fact, name of the petitioner has been dragged in the present case, on account of personal rivalry for some ulterior motive of the prosecution agency. He also refers to the medical record, appended with the present petition, and submits that much prior to the incident, the petitioner was RASHMI 2025.04.24 19:12 I attest to the accuracy and integrity of this document CRM-M-3964-2025 2 already undergoing treatment and just in the near past, surgery was also conducted. 4. Otherwise also, recovery shown by the prosecution against the main accused namely Gurdeep Singh @ Kuljeet is of recovery of 13.26 grams of heroin, which is non-commercial quantity. Thus, he prays for grant of concession of anticipatory bail to the petitioner. 5. Notice of motion. 6. On advance notice, Mr. Kanwar Sanjiv Kumar, AAG, Haryana, puts an appearance on behalf of the respondent/State. 7. List again on 20.03.2025, to enable learned State counsel to file status report in the matter. 8. In the meanwhile, the petitioner is directed to join the investigation as and when required to do so by the Investigating Agency. In the event of his arrest, the petitioner shall be released on ad-interim bail, subject to his furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also abide by all the conditions laid down under Section 482(2) of the BNSS, 2023. 9. Besides, petitioner would submit/surrender his passport before the Arresting Officer and an undertaking on oath that in case of leaving the country, he would seek prior permission from the Investigating Agency/concerned Court.” 3. Learned counsel for the petitioner contends that in compliance of the order dated 24.01.2025, passed by this Court, the petitioner has joined the investigation, and has fully co-operated. 4. Learned State counsel on instructions, confirms the said averment and submits that the custodial interrogation of the petitioner would not be required now for the purpose of investigation. 5. Heard learned counsel for the parties. 6. Since the petitioner has joined the investigation and custodial interrogation is no more required, present petition is allowed and interim order dated 24.01.2025, passed by this Court is hereby made absolute. However, petitioner shall continue to join the investigation as and when required to do so and abide by all the terms and conditions laid down under Section 482(2) of BNSS, 2023. Otherwise, would submit an affidavit, disclosing the fact that he does not possess any passport. It is also directed that before leaving country any time during trial, petitioner would seek prior permission of the Court. It is further made clear that if in future petitioner is found indulged in similar kind of activities, prosecution would be at liberty to seek cancellation of bail in the present case. 7.
