JUSTICE MITALI THAKURIA ORDER Date : 10.09.2025 This is an application under Section 482 of the BNSS, 2023, praying for grant of pre-arrest bail to the accused/petitioner, Shurjamal Islam, who is apprehending arrest in connection with Hatigaon P.S. Case No.20/2025 under Section 305(a) of BNS, 2023. Heard Mr. S. Munir, learned counsel appearing for the petitioner. Also heard Mr. D.P. Goswami, learned Additional Public Prosecutor appearing for the State. Page No.# 2/2 It is submitted by the learned counsel for the petitioner that the petitioner after obtaining the order of interim pre-arrest bail on 13.08.2025, had appeared before the I/O and extended his cooperation in the investigation of the case. He further submits that his statement has been recorded by the I/O and he is still ready and willing to cooperate in the further investigation of the case, if he is granted with the privilege of pre-arrest bail. Mr. D.P. Goswami, learned Additional Public Prosecutor has submitted in this regard that the accused petitioner appeared before the I/O and cooperated in the investigation of the case and his statement has also been recorded. Considering the submissions made by the learned counsel for both sides vis-a-vis, the conduct of the accused petitioner, I find that custodial interrogation of the petitioner may not be necessary for the purpose of investigation. In view of the above, the interim pre-arrest bail dated 13.08.2025 is hereby made absolute with the same terms and condition. Anticipatory bail application stands disposed of.
