Chatterjee, Special. P.P. --- 03 / 04.08.2025 Heard the parties. 2. Petitioner has been made accused in connection with Koderma P.S. Case No. 228 of 2024 corresponding to N.D.P.S. Case No. 08 of 2024 for the offences registered under sections 317(5)/3(5) of the Bharatiya Nyaya Sanhita, 2023 and section 18/22/27 of the N.D.P.S. Act, pending in the court of learned Principal District Judge-cum-Sessions Judge I/c, Koderma. 3. It is alleged that 58 grams of opium were recovered from the possession of the co-accused Rohit Kumar and on his confession, name of the petitioner has transpired. Though, petitioner has been named in the FIR, but nothing has been recovered from his possession. 4. It was submitted that the quantum of seized opium comes within the purview of intermediary quantity. It was finally submitted that similarly situated co-accused has been granted bail by this court earlier in B.A. No. 500 of 2025. 5 In view of the submission made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Principal District Judge-cum-Sessions Judge I/c, Koderma in connection with Koderma P.S. Case No. 228 of 2024 corresponding to N.D.P.S. Case No. 08 of 2024. (Ambuj Nath, J) Ranjeet/ Uploaded
