Heard Mr. Kh. Tarunkumar, learned senior counsel assisted by Ms. Julekha Khan, learned counsel appearing for the petitioners and Mr. S. Vijayand Sharma, learned senior panel counsel appearing for the respondents. [2] The present writ petition has been filed challenging the
order dated 01-04-2023 issued by the Brigadier, Deputy Inspector General, Assam Rifles, thereby dismissing the petitioner from service after holding a Departmental Inquiry. [3] Mr. S. Vijayand Sharma, learned senior panel counsel submitted that during the pendency of this writ petition and on

dismissal by granting pension and other pension related benefits as admissible under the rules. The learned senior panel counsel submitted that in view of the subsequent event that occurred specially issuance of the said order dated 28-11-2024, no cause survives for adjudication in the present writ petition and the same can be disposed of as infructuous. [4] Mr. Kh. Tarunkumar, learned senior counsel appearing for the petitioner fairly submitted that the petitioner is satisfied with the compulsory retirement order dated 28-11-2024 passed by the authorities in connection with the statutory appeal filed by the petitioner and as such, a prayer has been made for closing the present writ petition as infructuous. [5] In view of the submission made by the learned counsel appearing for the parties, the present writ petition is hereby disposed of as infructuous. Needless to mention here that the authorities will do the needful for releasing the pensionary and other retiral benefits due payable to the petitioner as soon as possible.
