OMP (M) 374 of 2025 The present application has been filed under Section 5 of the Limitation Act for condoning the delay in filing the present appeal. It has been averred in the application that the learned District Judge, Bilaspur H.P passed the award on 28.04.2025 and since the applicant is senior citizen and more than 93 years old therefore, on account of his ill health, he could not take appropriate steps in the matter. It has been submitted that the counsel, who has represented him, in the Court below, had advised him to prefer an appeal before this Court and consequently he applied for the copy on 16.06.2025 and the same was delivered on 01.07.2025. It has been further submitted that the delay in filing the appeal is neither intentional nor willful, but the same has occurred due to unavoidable circumstances, which were beyond the control of applicant. In view of the averments as made in the application, which is duly supported by an affidavit and in view of the submissions as made by the learned counsel for the applicant, the present application is allowed and delay of 21 days in filing the present appeal is ordered to be condoned.
