According to petitioner, he could not appear in the counselling held by District Education Officer (Primary), Pithoragarh for appointment as Primary School Teacher, and now, persons with lesser score of marks are permitted to appear for 5th round of counselling. 4. Learned State Counsel, however, submits that petitioner was given an opportunity to participate in the counselling; since he himself failed to appear for counselling on the specified date and time, therefore, he himself is to be blamed and now he cannot claim any relief. 5. Learned State Counsel relies upon a judgment dated 29.10.2025 rendered by this Court in WPSS No. 1730 of 2025 for contending that similar relief was denied to some other candidate. 6. Without going into the merits of the rival contentions raised by learned counsels for the parties, the writ petition is disposed of, as prayed by learned counsel for the petitioner, with liberty to petitioner to make representation to the Competent Authority. If petitioner makes representation to District Education 2025:UHC:9728 Officer concerned within one week from today, decision thereupon shall be taken within three weeks thereafter.
