PP CORAM: JUSTICE G. SATAPATHY Order No. ORDER(ORAL) 13.08.2025 03. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is a bail application U/S.483 of the BNSS by the petitioner for grant of bail in connection with Rourkela Township Sector-19 PS Case No. 38 of 2023 corresponding to GR Case No.879 of 2023 pending in the Court of learned SDJM(P), Rourkela for commission of offence punishable U/S. 302 of IPC, on the main allegation of committing murder of one Harish Chandra Nayak by stabling him. 3. Heard, Mr. Rakesh Behera, learned counsel for the petitioner, Mr. M.R. Patra, learned Addl. Public Prosecutor in the matter and perused the record. 4. After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-à-vis the allegation sought to be brought against him and regard being had to the DNA Profiling report of the blood stain stated to be found from the wearing apparel of the Petitioner together with the blood stain found from the spot and the weapon of offence and keeping in view the role as alleged against the Petitioner in this case and trial being continuing with examination of some of the witnesses and taking into account the law laid down by the Apex Court in X vs. State of Rajasthan & Another [Special Leave Petition (Criminal) No.13378 of 2024] disposed of on 27.11.2024, this Court is not inclined to grant bail to the Petitioner. Hence, the bail application of the petitioner stands rejected. In view of the alternative oral prayer as advanced for the Petitioner, the trial be expedited, if there is no other legal impediment. 5. Accordingly, the BLAPL stands disposed of. 6. Issue urgent certified copy of the order as per Rules. (G. Satapathy) Judge Priyajit
