CORAM :
SRI ANANDA SEN, J.
------ For the Petitioner(s) : Mr. Pratiush Lala, Advocate For the State : Mr. Sardhu Mahto, AddI. P.P
…......
05/ 19.06.2025 Heard, learned counsel for the petitioners and learned counsel for the State.
2.
The present anticipatory bail application under Sections 482 and 484 of the Bhartiya Nagrik Suraksha Sanha, has been preferred by the petitioners apprehending their arrest for the offences registered under Section 132/351(3)/3(5) of Bharatiya Nyaya Sanhita (B.N.S.),
2023.
3.
Learned counsel for the petitioners submits that petitioners have been falsely implicated in this case and the Circle Officer has lodged this case only to save his skin. He further submits that on the earlier occasion the petitioners have complained against the Circle Office due to non-entry of name in the Online Registration Portal. Since these petitioners have complained before the Deputy Commissioner and steps were taken against the officer concerned, the F.I.R. has been lodged, alleging that the petitioners have entered in the office of Circle Officer and obstructed him from performing his work.
4.
After hearing the parties, I find that the petitioners have earlier objected the manner, in which the office of the informant was functioning. They also have grievance that the online entries are not been made properly.
5.
Considering the aforesaid fact, I find that there is substance in the argument of learned counsel for the petitioner.
6.
The petitioners, above named, are directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of their surrender or arrest, they shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Court of J.M.F.C., Dhanbad in connection with Nirsa Police Station (Kalubathan O.P.) Case No.208 of 2025, subject to the condition that one of the bailers should be a close relative of the petitioners and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property.
