THE HONOURABLE SRI JUSTICE CHALLA GUNARANJAN WRIT PETITION No.10796 of 2025 ORDER: The present writ petition is filed under Article 226 of Constitution of India seeking following prayer: “to declare the action of the 2nd and 3rd Respondents in not extending the benefit of enhanced age of superannuation i.e., 62 Yrs under the amended provisions of Act 23 of 1984 and in seeking to superannuate the petitioners on completion of 60 years of age instead of 62 Years as illegal, Arbitrary, Violative of Art .14, Ultra vires the provisions of the Act No.23 of 1984 as amended from time to time contrary to the 2nd respondents service regulations 2013 without authority of the 2nd and 3rd respondents and violative of principles of natural Justice and pass such other order.” 2. Heard Sri P.V.A.Padmanabham, learned counsel for petitioners, learned Assistant Government Pleader for Services–II appearing for the 1st respondent and Sri V.Ch.Naidu, learned standing counsel, appearing for respondents 2 and 3. 3. Learned counsel for petitioner submits that A.P.EWIDC All Employees Welfare Association to which petitioners are members have submitted representation dated 02.04.2025 to extend the benefit of Act 4 of 2022 to the employees working with 2 CGR, J W.P. No.10796 of 2025 2nd respondent and since the same is pending, it would suffice to direct respondents to consider and dispose of the said representation, which essentially deals with enhancement of age of superannuation from 60 to 62 years. 4. Learned standing counsel appearing for respondents would submit that respondents 2 and 3 would consider and pass appropriate orders disposing the said representation in accordance with law. 5. In view of aforesaid submission, at the admission stage without expressing any opinion on the merits of the matter, with the consent of both counsel, this writ petition is disposed of directing respondents 2 and 3 to consider and pass appropriate orders on the representation dated 02.04.2025 made by A.P.EWIDC All Employees Welfare Association, within a period of six weeks strictly in accordance with law.
