Heard Mr. A. Ahmed, learned counsel for the petitioner. Also heard Mr. D.P Goswami, learned Additional Public Prosecutor for the State. Page No.# 2/3 2. This petition under Section 482 of the BNSS, 2023 has been filed by the accused petitioner, namely, Vikash Sisodia, seeking pre- arrest bail in connection with Dispur PS Case No.529/2025 under Section 108 of BNS, 2023. 3. The accused person is alleged to have abetted the suicide of victim. It emerges from the materials annexed to the bail petition that earlier, they had a business relationship over a private academic institution. The victim apparently left suicide note and the purported suicide note has been annexed with the bail petition. 4. The petitioner was granted interim pre-arrest bail on 04.08.2025. 5. I have perused the narration therein and case diary has been placed before the Court. 6. The learned Additional Public Prosecutor for the State objects to the grant of bail. 7. Upon going through some of the relevant flagged portions of the case diary, I find that there are some materials to indicate that as part of the business transaction, the accused petitioner allegedly put some monetary pressure on the victim and ultimately, he ended his life. The question of whether the acts of the accused petitioner constituted abetment, within the meaning of Section 45 BNS resulting in suicide of the victim, would be matter of full investigation and especially, a matter of trial based on evidence. 8. Nevertheless, at this stage, I do not deem it necessary to cancel the interim bail granted to the petitioner as it has been Page No.# 3/3 pointed out he has appeared before the I.O and his statement has been recorded. Accordingly, the interim bail granted to the petitioner vide order dated 04.08.2025 is hereby made absolute subject to the conditions : i) That the petitioner shall co-operate with the remaining investigation ; ii) That the petitioner shall not intimidate or harass the informant or his family; iii) That the petitioner shall not hamper or tamper with evidence. 9. Return back the case diary. 10. Violation of bail conditions might entail cancellation of the bail. 11. With the above observations, this anticipatory bail petition stands allowed and stands disposed of. JUDGE Comparing Assistant
