VIJAYA KUMAR NAIDANA The Court made the following: ORDER The instant Criminal Petition Criminal Procedure, under Section 482 of the Code of 1973 has been filed, by the Petitioners/A. seeking to quash the Proceedings against them in PRC No.13 ^ on the file of the Court of Judicial First Class Magistrate at Kothapeta Sections 376(2)(N), 354-D(1) for the offences punishable under 354-C and 417 IPC. 2. Heard Sri Vijay Kumar Petitioners. Ms.K.Priyanka Naidana, learned Lakshmi, learned Assistant Public appearing for respondent No. 1/State. Perused the material counsel for the Prosecutor on record, would submit that the parents of A.1 and they have They are falsely implicated in this case. 3. Learned Petitioners herein counsel for the Petitioners are brother and sister and nothing to do with the offence. 2 0 Learned counsel would submit that except bald and omnibus allegations, no specific overt acts are attributed against them. 4. Learned counsel would further submit that the presence of the Petitioners may be dispensing with before the trial Court in which the PRC is pending and the Criminal Petition may be disposed of by giving liberty to the Petitioners to raise such contentions before the trial Court in defence. 5. Considering the submissions made, the Criminal Petition is disposed of and the Petitioners are at liberty to raise the present contentions before the trial Court in their defence. However, the presence of the Petitioners/A.2 to A.5 before the trial Court is dispensed with, except on the specific dates as directed by the trial Court.
