The present applicant ‘Amit’ is in a judicial custody in relation to a Case Crime No. 318 of 2024 registered on the basis of First Information Report dated 17.12.2024 P.S. Gadarpur, District Udham Singh Nagar, wherein, the applicant has been implicated for the offences punishable under Section64 of B.N.S., 2023 and Section 5/6 of POCSO Act. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and there is a delay in lodging the FIR and furthermore he is languishing in jail since 17.12.2024 and have no previous criminal history. 5. Learned counsel for the applicant further submits that even otherwise as per the statement of the victim the relations in between the applicant and victim were consensual though the victim was minor at that time. 6. She further submits that after investigation the chargesheet has already been filed therefore there is no need of custodial interrogation. 7. Learned State counsel have not disputed this factthat the chargesheet has already been filed and therefore there is no need for custodial interrogation. 8. After hearing the arguments of learned counsel for the parties and further taking into consideration that since the chargesheet has already been filed and as such there is no need of custodial interrogation, this court is of the view that the applicant deserves for bail. 9. Accordingly, without expressing any opinion on the merit of the case bail application is allowed. 2025:UHC:1505 10.
