Mr. Mukesh Singh Rawat, learned counsel for the applicant. 2. Mr. Shobhit Saharia, learned counsel for the respondent-NCB. 3. Present applicant Chandan Singh Bhandari, S/ o Darshan Singh Bhandari is praying for bail in reference to Criminal Case No. 06 of 2025, Police Station NCB Dehradun, wherein the present applicant along with another co-accused have been implicated for the offences punishable under Sections 8/ 20 read with Section 29 of Narcotic Drugs and Psychotropic Substances Act, 1985. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and furthermore there is no substantial compliance of mandatory provisions of N.D.P.S. Act. He further submits that the alleged contraband Charas which is shown to be recovered is a joint recovery from both the persons and is non commercial quantity i.e. 605 gram. 5. The NCB file the counter affidavit and stated therein that all mandatory provisions of N.D.P.S. Act has been complied with. Yesterday, the counsel for the NCB was ask to get the inventory report as well as the certification, which is mandatory requirement in view of Section 52 of the N.D.P.S. Act. 6. Learned counsel for the NCB place before this Court the inventory as well as the certification and perusal of the inventory as well as the certification, this Court is of the view that the full compliance of Section 52-A of the N.D.P.S. Act. Apart from this, Mr. Shobhit Saharia also apprise to this Court the investigation 2025:UHC:10314 is still going on. 7. Be that as it may, admittedly, the Charas contraband which is shown to be recovered is a non commercial quantity and the applicant is languishing in jail since 25.09.2025. This Court is of the view and taking into consideration the alleged contraband is a non commercial quantity. The applicant deserves for bail. 8. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 9. Let the applicant “Chandan Singh Bhandari” be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
