Present petition has been filed by the petitioner challenging an order whereby the request of the petitioner for approval was rejected by respondent no.3 solely on the ground that the NOC of the State Government was not produced. 6. Contention of learned counsel for the petitioner that the said issue was considered in detailed by this Court in the case of M/s CM Karmyog Sewa Samiti v. State of U.P. & Ors.; 2025:AHC-LKO:48314. The issue raised by the present petition is squarely covered by the said judgement. 8. In view thereof, present petition is allowed. 9. Order dated 25.08.2025 in respect of B.Pharma Course is set aside. 10. Matter is remanded to the appellate authority to pass a fresh order. 11. While doing so, the appellate authority shall consider the mandate issued by this Court in the case of M/s CM Karmyog Sewa Samiti (supra) which shall apply to the present case also. 12. The decision shall be re-taken by the appellate authority within the time as laid down by the Supreme Court in M.A. No.711 of 2025 in Civil Appeal No.9048 of 2012 (Parshvanath Charitable Trust and Ors. v. All India Council for Technical Education and Ors.) 13. It is made clear that while doing so, the judgement of this Court in M/s CM Karmyog Sewa Samiti (supra) shall prevail over the guidelines that may have been issued by the PCI.
