Mr. Vipul Sharma, learned counsel for the respondent. 6. The petitioner of WPCRL No. 589 of 2026 Mr. Keshav Thalwal S/o Bolam Singh Thalwal is present pursuant to the previous order. 7. On the previous date pursuant to the arguments as advanced by Mr. Virk and after seeing certain video clips, which was shown by Mr. Virk on his mobile, the police administration was directed to proceed under Chapter XIII of Mental Health Care Act, 2017, but subsequent thereto Mr. Saurabh Kumar Pandey apprise to this court that no attempt was made by the police administration to call upon the petitioner. Consequently, the petitioner was called and now present before this court. 8. After interaction with the petitioner for half an hour in open court in the presence of counsel for all the parties he is directed to appear before the counsellors today itself so that the counsellors take assistance of Psychiatrist and the Doctors and interact and make an assessment of his mental condition and place the report on the next date. 9. Mr. Virk shall handover the videoclips to Mr. Dhaundiyal, the Senior Pharmacist, today itself. 10. On the previous date the record of two writ petitions WPCRL Nos. 1000 of 2021 and 1613 of 2023 were also summoned, which are now tagged with this file, wherein, the allegation of police atrocities has also been highlighted. 11. Mr. Saurabh Kuamr Pandey also place before this court one of the order of Chief Judicial Magistrate dated 25.05.2024 rejecting the application moved under section 156(3) of Cr.P.C. moved by one Smt. Pratibha Rai W/o Rajan Rai, the resident of Dehradun, making a complaint against six police officials including the S.H.O. Dharmendra Singh Rautela of P.S. Clementown, Dehradun, with the allegation that her son namely Prateek was torchered in the police custody. Certain photographs have also been enclosed and it has been apprised to this court that he was under regular treatment and subsequently this young boy of 21 years old died. 12. In reference to the aforesaid incident, now a revision has been preferred against the order of Chief Judicial Magistrate dated 25.05.2024 i.e. Criminal Revision No. 219 of 2024, which is pending since 2024 in the court of 1st Additional District Judge, Dehradun, and now the record of revision is being summoned and to find out if it is pending since 2024. 13. Registry is directed to summon the entire record of Criminal Revision No. 219 of 2024, which is pending in the court of 1st Additional District Judge, Dehradun, through a Special Messenger and place before this court on the next date. 14. Taking into consideration the seriousness of allegations as alleged all these matters are being kept part heard. 15. Put up this matter on 28.04.2026. 16.
