For the State : Ms. Amrita Kumari, A.P.P. …..... 04/19.06.2025: This anticipatory bail application under Section(s) 482 and 484 of BNSS has been preferred by the petitioners apprehending their arrest for offences registered under Section(s) 191(2), 191(3), 190, 126(2), 115(2) and 109 of BNS, 2023 in connection with Ketar P.S. Case No. 80/2024, pending in the Court of learned Judicial Magistrate, 1st Class, Nagar Untari, Garhwa. Heard the parties at length and had gone through the documents, annexed along with this application. Opportunity was given to the State to oppose the bail, which the State availed and opposed. It is alleged that the petitioners along with others came armed with deadly weapon and they assaulted the informant on his head, who was cutting crops in his land. Due to said assault on his head, the informant became unconscious and thereafter , he was taken to hospital where his treatment was done. From perusal of case diary as well as injury report and impugned order, it transpires that the witnesses have supported the occurrence and the informant sustained 3”x1/4”x1/4” lacerated wound, caused by hard and blunt substance, on the left side parietal area of head, which is grievous in nature. Considering the nature of injury, which is grievous in nature, I not am inclined to allow this anticipatory bail application. Accordingly, the prayer for anticipatory bail of the petitioners, above named, is rejected. Anu/-C.P.-3 (ANANDA SEN, J.)
