This is an application filed by the petitioner praying for grant of anticipatory bail in terms of under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, apprehending his arrest for offences under Sections 303(2)/ 132 of B.N.S., Rule 09 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017 & Rule 54 of Jharkhand Minor Minerals Concession Rule, 2024.
3. The learned APP opposes the prayer for anticipatory bail.
4. Petitioner is the owner of the Tractor which was transporting 100 cft. illegally mined sand.
5. Considering the nature of allegation, which has a severe impact on environment and State exchequer, I find that this is not a fit case for grant of anticipatory bail to the petitioner.
6. Thus, I am not inclined to entertain the anticipatory bail application. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Lohardaga P.S. Case No.37 of 2025, pending in the Court of learned C.J.M. at Lohardaga, stands rejected.
7. Petitioner should appear before the Court below.
