Smti. Priya Agarwal was appointed by the High Court Legal Services Committee (HCLSC) to represent the appellant. It appears that the appellant was not extended the legal aid for the purpose of preferring the appeal and the appellant cannot be held responsible or negligent for not being able to prefer the appeal, as it was the duty of the concerned Superintendent of Jail and the HCLSC to ensure that Serial No.06 Supplementary List 2025:MLHC:1238-DB legal service is extended to the under-trials as well as to the accused persons. 3. Although the delay is of 2294 days but having regard to the fact that he was in custody and was not provided the legal services to which he is otherwise entitled under the law, we condone the delay and direct the Secretary, HCLSC, to inform Smti. Priya Agarwal that henceforth she should be diligent in attending the matters assigned to her by the legal aid committee. 4. Accordingly, Crl.M.C.No.157 of 2025 is allowed. (H.S.
