1. This is the Second bail application filed under Section 483 of the B.N.S.S. for grant of regular bail to the applicant who has been arrested in connection with Crime No. 15/2024 registered at Police Station Odgi, District- Surajpur (C.G.), for the offence punishable under Sections
2 376(2)(n), 376(a)(b) and 450 of IPC and Section 06 of POCSO Act,
2012.
2. First Bail Application was dismissed as withdrawn by this Court vide
order dated 10.02.2025.
3. As per the prosecution story, on the date of incident, the complainant has lodged report to concerned police station Odgi that the applicant has again and again committed sexual intercourse with the prosecutrix at several times at several places. Based upon such complaint, the police has registered the offence punishable under Section 376(2)(n), 376(a)(b) and Section 450 of IPC and Section 6 of POCSO Act, 2012.
4. Learned counsel for the applicant contended that the applicant is innocent and has been falsely implicated in this case, he has not committed any offence as alleged against him. There is no specific evidence/ material available to connect this applicant in the alleged offence/crime. He is in jail since 31.01.2024. conclusion of trial may take some time, hence, applicants may be released on bail.
5. Per contra, learned State counsel opposes the bail application and submits that serious allegations have been levelled against the applicants, hence, they are not entitled for grant of regular bail.
6. I have heard learned counsel for the parties and perused the record with utmost circumspection.
7. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case, submission of the counsels, statements of the prosecution witnesses, I am not inclined to allow this bail application. Accordingly, the bail application of applicant- Dilip Sonwani @ Dilip Kurre involved in
3 Crime No. 15/2024 Section 376(2)(n), 376(a)(b) and Section 450 of IPC and Section 6 of POCSO Act, 2012 at Police Station Odgi, District- Surajpur (C.G.), is rejected.
8. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment.
9. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
