This is an application for condonation of delay in filing the special appeal, supported with an affidavit. 2. The causes shown in the accompanying affidavit are found sufficient. 3. The application for condonation of delay is allowed and the delay in filing the appeal is accordingly condoned. Memo of Appeal 1. Heard. 2. After going through the impugned order, we find, firstly, that it is an interim order, secondly, the ground on which the same has been granted is that the proceedings under Regulation 351-A of Civil Service Regulations could be instituted only within four years of the event which is the basis for issuance of the charge sheet, whereas, in the case at hand, the charges pertain to the posting of the petitioner at Ballia during 18.12.2017 to 14.03.2018, whereas the charge sheet was issued allegedly in terms of Regulation 351-A of Civil Service Regulations on 15.06.2022, therefore, we are not inclined to interfere with the impugned interim order in an intra Court appeal under Chapter VIII Rule 5 of the Allahabad High Court Versus Counsel for Appellant(s) : Rishabh Kapoor, Krishna Kumar Vishwakarma Counsel for Respondent(s) : Rajendra Pratap Singh Board Of Directors Jal Nigam Urban Lko. And 2 Others .....Appellant(s) Kamlesh Singh .....Respondent(s) Rules, 1952. 3. The appeal is accordingly dismissed without prejudice to the rights of the appellants to contest the matter before the Writ Court.
