This writ petition has been filed under Article 227 of the Constitution of India, whereby the petitioner wants to expedite hearing of the Original Suit No.203 of 2003, Church of North India Trust Association and others Vs. Rajan Peter Singh and others, pending in the court of learned Civil Judge (S.D.), Dehradun. 2. It is contended by counsel for the petitioner that the said original suit was instituted on 08.04.2003 for cancellation of sale deed and permanent injunction. It is further submitted by him that pleadings have been exchanged between the parties by filing written statement on 28.05.2003. He also informed this Court that due to various challenges thrown before this High Court, the matter was pending for the last ten years, but now there is no impediment and the case can now be decided. 3. Learned counsel for the petitioner has annexed entire order sheet of the Original Suit No. No.203 of 2003. 4. Having heard learned counsel for the petitioner and perusal of the record, this Court is quite surprised that the Original Suit No.203 of 2003 is still pending disposal. 1 5. Since the recording of evidence of the parties has yet not been started therefore it will be in the fitment of facts and circumstances that a direction be issued for expeditious disposal of the suit. 6. Accordingly writ petition stands allowed. 7. Learned Ist Additional Civil Judge (S.D.), Dehradun is directed to expedite hearing of the Original Suit No.203 of 2003, Church of North India Trust Association and others Vs. Rajan Peter Singh and others, and it shall be decided expeditiously not later than two years from the date of production of certified copy of this order. (Pankaj Purohit, J.) 30.10.2025 SK 2
