KAMAL - 3 - NC: 2025:KHC:6040 WP No. 3778 of 2025 ORAL ORDER Petitioners who have been granted a relief of compensation under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 in respect of land measuring 35, forming part of Sy.No.59, Situated at Kallubalu Village, Jigani Hobli, Anekal Taluk, Bengaluru District in terms of judgement and order dated 19.10.2024 in L.A.C.No.1/2019 on the file of I Additional District and Sessions Judge, Bangalore Rural District, Bengaluru are before this Court seeking following reliefs: (a) Writ in the nature of the mandamus directing the respondents to pay and deposit the decrital amount in sum of Rs.3,19,89,040/- (Three Crore Nineteen Lakhs Eighty Nine Thousand Forty only), as per Annexure-A dtd. 19.10.2024 as per award and decree passed by the learned 1st Addl. This petition is essentially in the nature of an execution petition. Learned counsel for the petitioner on a query by this Court submits that though the petitioner has - 4 - NC: 2025:KHC:6040 WP No. 3778 of 2025 initiated execution proceedings in Ex.Case.No.15/2024, petitioner has no hope of recovering the money from the respondent-authority, unless a direction is issued by this Court. Such a plea cannot be countenanced inasmuch as the award passed by the Reference Court is capable of execution under the provisions of the Order 21 of CPC. The writ petition cannot be converted into execution proceedings. 3. Reserving liberty to the petitioner to pursue the execution proceedings and avail the remedy provided under the law for recovery/enforcement of the award, petition is disposed of. SD/- (M.G.S.
