HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 9556 of 2025 Court No. - 4 HON'BLE ABDUL MOIN, J. 1. Heard learned counsel for the petitioner and Sri Aditya Mohan, learned counsel, who files Vakalatnama on behalf of the respondents. 2. With the consent of learned counsels for the parties the matter is being decided finally. 3. The contention of learned counsel for the petitioner is that despite the petitioner having submitted the medical bills for reimbursement as approved by the AIIMS for Rs.3,46,854.24 the same has not been paid to the petitioner till date. 4. On the other hand, Sri Aditya Mohan, learned counsel for the respondents states that the reimbursement has been considered by the respondents in terms of the rules as applicable in the U.P. Jal Nigam as issued vide order dated 28.06.2016 but the same have been found to be time barred as they had been submitted after a period of three months consequently the same have not been processed. 5. Responding learned counsel for the petitioner states that this Court in the case of Mohammad Aslam and 4 others vs. State of U.P. and others - 2023: AHC-LKO:13968, a copy of which is Annexure-9 to the petition, has held that medical reimbursement is to be considered in accordance with the Medical Care Rules, 2011 as issued by the State Government. Consequently, there cannot be any occasion for the Versus Counsel for Petitioner(s) : Ajay Kishor Pandey, Tanveer Ahmad Lari Counsel for Respondent(s) : Samir Om Jai Bhagwan Vatsa .....Petitioner(s) U.P. Jal Nigam Rural Thru. Its Managing Director, Lko. And 2 Others .....Respondent(s) respondents to have placed reliance on the rules as applicable in the Jal Nigam. 6. A perusal of the judgment in the case of Mohammad Aslam (supra) indicates that this Court has directed the Jal Nigam to consider the medical bills strictly in accordance with the Medical Care Rules, 2011 and as such it is apparent that there cannot be any occasion for the respondents to have considered the medical reimbursement of the petitioner in terms of the rules as applicable for the Jal Nigam. 7. Considering the aforesaid, the writ petition is disposed of with a direction to the respondents to consider the reimbursement of the medical bills of the petitioner in accordance with the Medical Care Rules, 2011. 8. Let such consideration be made within a period of four weeks from the date of receipt of a certified copy of this order. 9.
