The order dated 10.12.2024 passed by the respondent no. 5 Basic Shiksha Adhikari Mainpuri, District Mainpuri is under challenged in the present writ petition. By the aforesaid order, the petitioner has been terminated from his services. 2. A preliminary objection has been raised by Sri Manvendra Singh, learned counsel appearing on behalf of respondent no. 3 that the statutory alternative remedy is available to the petitioner to file an appeal as provided under Rule 5 of the U.P. Basic Educational (Staff) Rules, 1973. 3. Heard counsel for the parties and perused the record. 4. In the facts and circumstances of the case, without interfering with the order which is under challenge in the present writ petition, the writ petition is disposed of finally permitting the petitioner to file an appeal against the aforesaid order as provided under Rule 5 of the U.P. Basic Educational (Staff) Rules, 1973. 5. In case the petitioner will file an appeal before the appellate authority within a period of three weeks' from today, the appellate authority will consider and decide the same in accordance with law most expeditiously and preferably within a period of four months from the date of production of certified copy of this order but without granting unnecessary adjournment unless there is no legal impediment.
