HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 7944 of 2025 Court No. - 12 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant and learned A.G.A. for the State. It has been contended by the learned counsel for the applicant that the applicant is in jail since 17.03.2025 in Case Crime No. 102 of 2025, under Sections 3(5), 115(2), 352, 351(3), 105 of B.N.S., 2023, Police Station- Ramnagar, District- Barabanki. It has been submitted that the applicant has been falsely implicated in this case as he has not committed any offence as alleged. Attention has been drawn towards the impugned F.I.R. wherein general allegation of assault and beating has been attributed to seven accused persons. So as to implicate the entire family, the concocted prosecution story has been prepared. No specific role has been attributed to the present applicant. The applicant is having no criminal history of any kind whatsoever. Attention has been drawn towards the anticipatory bail order dated 09.07.2025 passed in Criminal Misc. Anticipatory Application U/S 482 B.N.S.S. No. 817 of 2025 whereby the co-accused, namley- Malti Devi has been granted anticipatory bail and the order dated 15.07.2025 passed by this Court in Criminal Misc. Bail Application No.4364 of 2025 whereby the co-accused, namely-Gayatri, Babli and to the orders dated 24.07.2025 and 25.8.2025 passed in Criminal Misc. Bail Application Nos. 6685 of 2025 and 7929 of 2025 whereby the co-accused Ramsagar and Versus Counsel for Applicant(s) : Mohd. Salman Counsel for Opposite Party(s) : G.A. Ajay .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. .....Opposite Party(s) Ram Saharey have already been granted bail. The case of the present applicant is similar to the said co-accused. Learned Counsel for the applicant has further submitted that the co- accused named above, who have been assigned the similar role, have been enlarged on bail by this Court. He also submits that since similar role has been assigned to the present applicant and case of the applicant is in parity with the co-accused persons, therefore, the present applicant is also entitled for bail. He has further submitted that charge-sheet has already been filed, there is no apprehension of absconding or tampering the evidence or witnesses. The learned counsel for the applicant has given an undertaking on behalf of applicant that the applicant shall not misuse the liberty of bail and shall cooperate with the trial proceedings and shall abide by all terms and conditions of bail, if granted. Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for the applicant. Without entering into the merits of the case and considering the arguments of learned counsel for the parties, contents and allegations of F.I.R. and the fact that the co-accused persons named above, who have been assigned the similar role, have been enlarged on bail by the coordinate bench of this Court as well as by this Court, therefore, on the principle of parity the applicant is entitled to be released on bail in this case. The bail application is allowed. Let the applicant- Ajay involved in aforesaid case crime be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions which are being imposed in the interest of justice:- (i) The applicant shall file an undertaking to the effect that he shall not seek any adjournment on the dates fixed for evidence when the witnesses are present in court. In case of default of this condition, it shall be open BAIL No. 7944 of 2025 2 for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law.
