HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 8240 of 2025 Court No. - 6 HON'BLE PANKAJ BHATIA, J. 1. Heard learned counsel for the petitioner. 2. The present petition has been filed by the petitioner challenging the appellate order dated 15.05.2025, whereby the appellate authority has remanded the matter for consideration afresh. 3. The submission of learned counsel for the petitioner, who is a subsequent allottee, is that the petitioner was not heard when the appeal was decided. On consideration of the allotment order in favour of the petitioner, it is clear that the allotment of the petitioner was subject to the outcome of the litigation initiated by the original allottee. 4. Considering the fact that the matter has been remanded only, no good ground for interference is made out as the remand order itself indicates that till a fresh decision is arrived, the petitioner would continue with the fair price shop. 5. Accordingly, the writ petition is dismissed.
